Mind Motivations® App-Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Mind Motivations® wellness app ("App"), provided by Forever KTL PTY LTD (ABN 71 665 473 496) ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1.1 The App provides users with access to hypnotherapy and meditation MP3s designed to support clarity, balance, and overall well-being.
1.2 You agree to use the App in accordance with these Terms and all applicable local, state, national, and international laws.
1.3 The App is intended for individuals aged 16 and over. By using the App, you confirm that you meet this age requirement.

4.2 The name Mind Motivations®, associated logos, and related branding elements are registered trademarks of Forever KTL PTY LTD. Unauthorized use is strictly prohibited.
4.3 You may not copy, reproduce, reverse engineer, distribute, or publicly display any content from the App without prior written permission.
4.4 Do not remove, obscure, or alter copyright or trademark notices on the App.
4.5 Any unapproved use of the App’s content may result in legal penalties.

9.1 These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in Queensland.

10.1 Competitors are prohibited from accessing the App for competitive purposes without written consent.
10.2 Breach may result in legal action and account suspension.

13.1 Compulsory Process: Disputes may not proceed to court unless the process below is followed (except in urgent cases).
13.2 Notice of Dispute: A party must give written notice outlining the nature of the dispute and resolution sought.
13.3 Good Faith Negotiation and Mediation: Parties must try to resolve the dispute within 14 days. If unresolved, a mediator shall be appointed by the President of the Australian Mediation Association. Costs shared equally.
13.4 Confidentiality: All communications during dispute resolution shall remain confidential and “without prejudice.”
13.5 Termination of Mediation: If unresolved after 2 weeks of mediation, either party may pursue other legal options.

14.1 The App is intended for Australian users. Disputes will be resolved in the courts of Queensland, Australia.

15.1 You acknowledge that you have had the opportunity to seek legal advice and that these Terms are fair and reasonable.

16.1 If any part of these Terms is found to be invalid or unenforceable, the rest shall remain in full effect.
